1. Sale & Purchase:
1.1 You place an order for products from the site by selecting the required quantity and then clicking "Add to Basket" to transfer the items to your shopping basket. This process may be repeated for however many items you wish to purchase. After each selection, the cumulative content of your shopping basket is displayed. While in the shopping basket screen, you can alter the quantity of any item, or delete any item then press "Update" to recalculate the cost.
From the shopping basket screen, you can proceed to the checkout by pressing "Checkout". You then proceed through a sequence of screens by pressing "Next". First you select your delivery address, either directly or by having logged in previously, then you enter your preferred method of delivery, then you are given a last opportunity to amend your personal or order details.
Finally, you press "Payment" and are transferred to our secure payment service provider (Protx) to complete the ordering process by providing your credit or debit card details.
1.2 The contract in respect to products supplied by us to you comes into effect when your order has been accepted (see Acceptance of Order), at which point a binding agreement between The Dyslexia Shop ("the seller") and yourself ("the buyer") will be in place based on these terms & conditions.
2. Acceptance of Order:
2.1 We are under no obligation to accept your order, but under normal conditions will do so where the product is available, the order reflects current pricing, and the form of payment (credit / debit card) has been approved by your credit / debit card company. For the avoidance of doubt, receipt of an order via the site does not constitute acceptance of an order.
2.2 We will notify you of our acceptance of your order via email or where email is not available, by telephone. If we do not accept your order, for any reason, or the price has changed between the time of your order and our acceptance (or if an additional charge applies), we will notify you by email or where email is not available, by telephone. In this instance, you will have to resubmit your order.
2.3 In the case that for any reason products are not available, after we have accepted your order, we will notify you and not charge you for the products and/or refund any amounts already paid (if any) by way of credit to your credit / debit card account.
3. Price:
3.1 The prices quoted are in pounds sterling and are inclusive of VAT, except when the given delivery address is outside the European Union, unless otherwise stated.
3.2 The total order price is inclusive of packaging and delivery to the given address, unless otherwise stated..
3.3 Prices are correct at the time of order and are subject to availability. As mentioned above, if the price has changed between the time of your order and our acceptance (or if an additional charge applies), we will notify you by email or where email is not available, by telephone. In this instance, you will have to resubmit your order.
4. Payment:
4.1 Payment must be made in the pounds sterling (GBP) and only by major credit or debit cards (Currently American Express, VISA, Visa Electron, Master Card, Delta, Solo or Maestro).
5. Postage, Packaging and Delivery:
5.1 UK mainland deliveries will be by Royal Mail using either UK 1st Class Post (usually using "Recorded, Signed for", but see clause 5.2), Special Delivery Next Day Before 1:00PM, or UK Parcel Post as selected by you during the ordering process.
5.2 1st Class Post deliveries will not be recorded for orders of value less than £20.00.
5.3 Delivery will be charged at the Royal Mail rates prevailing when the order is accepted, or at a lower rate determined by us. The rates are as listed on the Royal Mail website at www.royalmail.com. There will be an additional charge for packaging materials. You will be shown the exact packaging and delivery cost for your product selection before you have to commit to placing your order.
5.4 Any date or period of delivery mentioned on the site or on advertising material is indicative only. If the item is in stock it will be dispatched the next working day.
5.5 If the item is not in stock we will make every effort to deliver products within 7 to 14 working days of acceptance of your order. In extreme circumstances, e.g. where we are awaiting delivery of stock, we will notify you and, unless stated otherwise, ensure that your products are delivered to you within 28 days. We will not, without your prior written agreement, supply you with substitute goods.
5.6 International deliveries will be sent by Royal Mail Airmail Small Packet Service and the contents will be declared on a CN22 label affixed to the parcel.
5.7 We may, at our expense, deliver parts of your order separately.
5.8 At our discretion, deliveries may be sent by recorded or special delivery and must be signed for upon receipt. Deliveries will only be made to the address of the person who is the holder of the credit / debit card used to purchase the products, unless a prior arrangement has been made with us.
5.9 Ownership and risk shall pass on to the buyer, once the products have been signed for.
5.10 You MUST sign for all your parcels as UNCHECKED, as we will not be able to deal with your claim if they haven't been signed as UNCHECKED.
5.11 If you find your goods to be damaged in transit you must notify us within 48 hours. Failing to do so will result in us not being able to deal with your claim.
5.12 If we cannot deliver the products to you at the specified address, unless we are at fault, we will notify you and store the products until you instruct us to redeliver. In this instance you would have to authorise us to charge your credit / debit card for the re-delivery. If we do not hear from you within 28 days, we will cancel the order and refund your payment to you, less any charges (delivery or administration) that we have incurred.
6. Right to Cancel and Return the Goods:
6.1 Your rights are determined by the Consumer Protection (Distance Selling) Regulations 2000.
6.2 After the products have been delivered to you, you have 14 working days to examine the goods.
6.3 Subject to exceptions specified in section 6.7, 6.8 and 6.9, you have the right to cancel your contract with us at any time during the first 14 working days, commencing on the date after the delivery of the products.
6.4 Any such cancellation must be in writing by post, facsimile or email with your contact details or customer number and your order / invoice number. If no such action is taken, we will consider the products as being as described or satisfactory quality and fit for their purpose, and will not accept any cancellation at a later date. This does not affect your statutory rights.
6.5 If your notification reaches us prior to the dispatch of the goods, we will be happy to cancel the order at no expense to you, unless we have incurred any type of directly related charges, for which you would then be liable.
6.6 We will refund any amounts we have collected in form of credit on your credit / debit card or by cheque within 30 days, less the postage charge we have incurred for sending the parcel.
6.7 HOWEVER, you must return the products to us in their original packaging, unused, with the invoice / receipt and at your own expense. Nutritional supplements are considered to be used if the container's seal is broken.
6.8 Compact discs (CDs), digital versatile discs (DVDs), and magnetic tapes (e.g. cassettes) containing computer software, audio or video recordings cannot be returned if they have been unsealed.
6.9 Periodicals, magazines and items that have been made or customised to your specification cannot be returned.
6.10 We are not responsible for the goods until we have received and signed for them. If you would like for us to arrange collection you will incur a charge.
6.11 In circumstances where the rejection or cancellation is due to a defect or discrepancy in the order, you will not be liable for the return delivery charges, as mentioned in paragraph 6.6. If when we receive the returned goods we assess that the goods were defective or there was a discrepancy in the order, we will credit back to you the return delivery charge. In such circumstances you would need to provide us with the courier receipt.
